By accessing or using PreviewFile.dev ("Service", "Platform", or "we"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

2. Description of Service

PreviewFile.dev provides a secure file preview service that enables users to:

Generate secure short links that hide original file URLs
Upload and preview files with configurable security policies
Embed file previews in websites and applications via API
Apply watermarks and download restrictions to protect file content
Create one-time access links and set custom TTL (Time To Live)

3. Account Registration

3.1 Account Creation

To use advanced features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as needed.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Eligibility

You must be at least 18 years old and able to form a binding contract to use our Service. By using the Service, you represent and warrant that you meet these requirements.

4. Subscription Plans and Payment

4.1 Plans

We offer multiple subscription tiers with varying file storage limits, short link quotas, and features. Current pricing is available at https://previewfile.dev/docs/pricing.

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe. You authorize us to charge your payment method for the applicable subscription fees.

4.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings.

4.4 Refunds

We offer a 14-day money-back guarantee for new subscriptions. Refund requests must be submitted within 14 days of the initial purchase. Refunds for subsequent billing periods are handled on a case-by-case basis.

4.5 Storage and Bandwidth Limits

Each plan has specific storage and bandwidth limits. Exceeding these limits may result in service degradation or additional charges.

5. Acceptable Use Policy

You agree not to use the Service to:

Violate any applicable laws or regulations
Upload, store, or share illegal, harmful, or infringing content
Distribute malware, viruses, or harmful code
Violate intellectual property rights of others
Engage in phishing, fraud, or deceptive practices
Harass, abuse, or harm other users
Use the service to host or distribute spam
Attempt to gain unauthorized access to our systems
Circumvent security features or usage limits
Upload content that violates privacy rights of individuals
Share sexually explicit or violent content (except where legally permitted and disclosed)

6.1 Your Content

You retain all ownership rights to the files you upload and URLs you share. We do not claim ownership of your content.

6.2 License to Us

By uploading files or creating short links, you grant us a limited license to store, process, display, and deliver your content solely for the purpose of providing the Service.

6.3 Content Responsibility

You are solely responsible for ensuring:

You have the rights to upload and share the files
The content does not violate any laws or third-party rights
You have obtained necessary permissions for shared content
The content complies with our Acceptable Use Policy

6.4 Prohibited Content

You may not upload or share:

Child sexual abuse material (CSAM)
Content that infringes copyrights or trademarks
Malware, viruses, or malicious code
Content that violates export control laws
Personal information of others without consent
Content that promotes terrorism or violence

7. Security Features and Watermarks

7.1 Security Policies

You can configure security policies including:

Disable download buttons
One-time access links
Custom TTL (Time To Live)
Dynamic watermarks with user information

7.2 Watermark Accuracy

Dynamic watermarks display viewer information (IP, timestamp, etc.). This information is provided "as is" and may not always be accurate due to proxies, VPNs, or network configurations.

7.3 No Guarantee of Protection

While security features help deter unauthorized sharing, they do not prevent determined users from capturing content via screenshots, screen recording, or other means.

8. API Usage

8.1 API Access

API access is provided according to your subscription tier. You must use your API key securely and not share it with unauthorized parties.

8.2 Rate Limits

API usage is subject to rate limits based on your subscription plan. Exceeding rate limits may result in temporary throttling or service suspension.

8.3 API Changes

We reserve the right to modify, deprecate, or retire API endpoints with reasonable notice.

9. Data Ownership and Privacy

9.1 Your Data

You retain all ownership rights to the files, URLs, and data you upload or share through our Service.

9.2 Privacy

Our collection and use of personal information is governed by our Privacy Policy. By using the Service, you consent to our Privacy Policy.

9.3 Data Deletion

You can delete files and short links at any time. Upon deletion, content is removed from our systems within 30 days.

10. Intellectual Property

10.1 Our IP

The Service, including all content, features, and functionality, is owned by PreviewFile.dev and is protected by copyright, trademark, and other intellectual property laws.

10.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your business purposes, subject to these Terms.

10.3 Restrictions

You may not:

Copy, modify, or create derivative works of the Service
Reverse engineer or attempt to extract source code
Remove any copyright or proprietary notices
Resell, sublicense, or transfer your rights to use the Service
Create a competing service using our platform

11. DMCA and Copyright Infringement

URL or identifier of the infringing material

Good faith statement
Statement of accuracy under penalty of perjury

11.2 Counter-Notification

If your content was removed due to a DMCA claim and you believe the removal was in error, you may submit a counter-notification.

11.3 Repeat Infringers

We will terminate accounts of repeat copyright infringers.

12. Service Availability

12.1 Uptime

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with advance notice when possible.

12.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

13. Termination

13.1 By You

You may terminate your account at any time by canceling your subscription through your account settings or contacting us.

13.2 By Us

We may suspend or terminate your account if you:

Violate these Terms
Upload prohibited content
Fail to pay fees
Engage in fraudulent or malicious activities
Use the Service in a way that poses security or legal risks

13.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Your uploaded files and short links will be deleted. You may request a data export before termination.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

WE DO NOT GUARANTEE THE SECURITY OR PRIVACY OF YOUR FILES. WHILE WE IMPLEMENT SECURITY MEASURES, YOU USE THE SERVICE AT YOUR OWN RISK.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PREVIEWFILE.DEV BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 IF YOU HAVE NOT PAID US.

16. Indemnification

You agree to indemnify, defend, and hold harmless PreviewFile.dev and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:

Your use of the Service
Your violation of these Terms
Your violation of any rights of another party
Files, URLs, or content you upload or share
Copyright infringement or other IP violations

17. Dispute Resolution

17.1 Governing Law

These Terms are governed by the laws of the jurisdiction where PreviewFile.dev is incorporated, without regard to conflict of law principles.

17.2 Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court to prevent infringement of intellectual property rights.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PreviewFile.dev regarding the Service.

18.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

18.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

19. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on our website and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
